Hi there,
Here is my situation, any help to resolve this is appreciated.
- My self (primary) & my wife's(derivative) I-485's (PD June 2002) were filed in March 2007.
- My I-485 was approved in July 2007, my wife's was pending due to NC.
- My wife's employer filed PERM (PD June 2007) & then filed I-140 in March 2008.
- We recently contacted NSC regarding my wife's case status, we received a letter from them stating that, her I485 is waiting for I-140 to get approved.
They linked her new I-140 to her pending I-485 that was filed as derivative.Is this USCIS error?.How to correct this error and have them consider her I-485 application as a derivative application?.

get your facts right first. India is not actively supporting sri lanka. It would be suicidal for india (especially considering nutcases like you that exist) to even think of that again. Sri lanka is using israeli uav's and chinese fighter aircraft and artillery to fight the ltte. In fact, india is at a strategic disadvantage now because we choose not to help sri lanka militarily. And in fact, sri lanka has always suspected india of supporting the ltte. Read about the "string of pearls" geopolitical strategy of china before letting your emotions run crazy.

Fyi, i am not tamilian but i have lived in tamil nadu for more than 10 years and can speak it fluently. Needless to say, i have a lot of tamilian friends and know the culture. I understand the suffering that the sri lankan tamils are going through, especially in the mullattivu region. But we have to understand this is a war which has been going on for decades now. What do you expect to happen in a war? Rave parties?
Anyway hopefully, this will mark the end of the sufferring of both sri lankan tamils and sinhalese from now on. Both sides in that country have gone through enough already.

Indian body shoppers employ a H1b Persons and many of them are in hourly. No project then no pay. Also because of H1b and GC employer has complete control over the employees about pay and other benefits. No pay in bench is violation of law and both employee and employer are willingly accept that. Because of that employer and employee does not have any risk and employer always make huge profits without exposure of any risk. Employee also does not have any risk of losing GC process. So our body shoppers are attractive destination for GC aspirants.
The companies which follow rules are forced to pay bench or lay off. So both employee and employer are risk of survival. Companies may be under risk of heavy loss when there are too many people are in bench. That means companies which follow rules and regulations are making loss in tough times at the same time Body shops always make money and worst case scenario no loss no gain. Also GC process is uncertain for those who are working in good companies

Simple. If it wasn't for that ceiling the vast majority of the visas will go to applicants from the oversubscribed countries. Now this is not a bad thing if the visas are in unlimited supply. But since that's not the case, the country ceiling ensures that even people from smaller nations will get an equal oportunity to claim a visa before all the visa are grabbed by their BIG brothers and sisters. And what's more what ever is left is given back to the oversubscribed countries.
How can you call that unfair? Is it fair to deprive a person from a smaller country, equal chance to have go at his GC?
I understand how the current system prevents people of one nationality obtaining all the visas but I am not sure how it prevents any one group or sector monopolizing. Care to clarify?

The obsolete immigration laws do not address this need and government missteps further contribute to the persecution of law abiding skilled legal immigrants who wait patiently in line and live with severe restrictions for many years while their immigration cases are processed.

Sure EB5 has to do. The Amwayers and Quicksteres claim to have entrepreuners and also claim to make millions (just like you are on your way to make millions). These are the two things required to get a GC in EB5. So if you are just reacing millions you should definitely plan for EB5 GC freeing up one valuable EB3 spot :rolleyes:

Allowing anybody with an approved labour certification to immediately file for their 485 is clearly a bad idea given the constraints of the system as outlined by unitednations. We could make a change in our proposal so that only people with, say, a five year old priority date and an approved 140 could file for their 485 without a current priority date. oguinan
